Bail denied for man accused of slashing tires, assault

Lorne Charland will remain behind bars, at least for now.

On Tuesday, Sept. 4, Charland appeared in the Bonnyville Provincial Courthouse to discuss the possibility of bail.

He has been charged with assault and mischief, after slashing his former girlfriend's tires and hitting her in the face.

On Jan. 1, Cold Lake RCMP were called to Cold Lake First Nations regarding a domestic dispute.

The complainant said Charland had slashed three tires with a knife and slapped her in the face before leaving on foot.

They claim he was intoxicated.

A witness, and a red mark below the victim's eye, confirmed her statement, and police began patrolling the area.

Officers were unable to locate Charland, but on Aug. 28 his luck ran out.

Cold Lake RCMP were assisting in an unrelated arrest when Charland was arrested on outstanding warrants.

Crown prosecutor Tyler McLean noted Charland's record, which is lengthy with related charges.

His record, McLean said, spans over 30 years with "no significant breaks."

Charland has five prior failing to comply convictions and five violence-related convictions.

In 2014, he was convicted of aggravated assault, and spent two years in custody as a result.

Acting duty counsel David MacLeod described Charland as an Indigenous man who's a father of three. Alcoholism runs in the family, and is an issue for Charland, he said.

MacLeod suggested a $1,000 no-cash recognizance as the opportune bail option, adding if strict conditions were in place, Charland would follow them.

"The fact that the record is consistent year after year, there's no order that could be put in-place to prevent the accused from reoffending," McLean expressed. "(Bail) would undermine the public's faith in the administration of justice."

Honourable Judge Kathleen Williams agreed that the 48-year-old's record, which contains 55 different conditions over the last 30 years, was an aggravating factor.

"It's a violent crime and it's a breach of trust," Williams said about the charges.

Charland was denied bail and will appear in the Cold Lake Provincial Courthouse on Sept. 12.
